Choosing Your Legal Business and Domain Names

    I will cover some of the points you need to consider when choosing domain and business names below. As a disclaimer, this article does not cover everything you need to know to protect yourself legally from infringing on someone's trademark or copyright. This article is meant as a starting point for you as you go about finding out everything you need to know to register your domain and legal names for your business.

    A good way to go about choosing the two names you need is to have them match identically. This would be preferred and should be your first priority.

    Fire up your web browser and have a look at "Google" and "Yahoo" search engines for the name you want your business to be called. Search variations, and search for a long time to see if results pop up for a business already named the same thing - and that is in a similar niche as the one you are starting. Business names can be duplicates, as long as the niche they operate in is significantly, substantially different. A court of law would decide that.

    Searching through search engines is mandatory because your state will let you register any corporation name that isn't already taken by someone else - without a nationwide search. If someone in the state next to you, or across the country in Hawaii is named the same thing - you need to know, and you need to know whether your business is similar to theirs in any way - or, you may find yourself in court someday.

    If you wanted to choose a company name like, "McDonald's". A cursory check in Google or Yahoo would show you that 75 million (a guess) entries already show up for that keyword, and many of them are referring to businesses. One of those businesses makes hamburgers, fish, and chicken sandwiches. This means, if you make any food items close to something McDonald's makes you will probably receive a letter from their team of lawyers asking you to change your name because it conflicts with their client's business name.

    This process, though you might think is excessive is absolutely necessary for every business you want to start. As I said earlier, this is not everything you need to know - but, a good starting point.
