National Arbitration Forum received 2,082 domain name cases

  • National Arbitration Forum announced that they have received 2,082 international domain name disputed complaints last year . You can read the press release after the jump : "The National Arbitration Forum (FORUM), an international provider of dispute resolution services, today announced that a total of 2,082 cases were filed in its domain name dispute resolution program in 2011, up 18 percent from 2009 (1,759 cases) and down four percent from 2010 (2,177 cases). Since the FORUM's first case in 1999, nearly 18,000 cases have been filed as of the end of 2011. The FORUM is approved by the Internet Corporation of Assigned Names and Numbers (ICANN) to provide domain name dispute resolution services under policies like the Uniform Domain Name Dispute Resolution Policy (UDRP). The following data pertains to the National Arbitration Forum domain name dispute resolution program in 2011 (January 1 to December 31, 2011): More than 2,000 cases filed (96.2 percent) involved generic top-level domain (gTLD) names including .com and .org under the UDRP. Approximately 70 cases involved a .us top-level domain under the United States Dispute Resolution Policy (usDRP). Three cases were administered under the United States Nexus Dispute Policy (usNDP). Ten cases were administered under the FORUM's new Rapid Evaluation Service (RES) for .xxx domain names. Panelists heard and decided 1,734 of the 2,082 cases filed; parties worked together to settle a majority of the remaining cases. UDRP cases, on average, concluded 35 days from commencement; some cases concluded in fewer than 20 days. "Our experience tells us parties, particularly domain name registrants, prefer the National Arbitration Forum because documents are easily accessible in our online portal," said Kristine Dorrain, Director of Internet and IP Services, who manages the FORUM's dispute resolution programs at National Arbitration Forum. "Complaint or Response filing is accomplished in just a couple of minutes." FORUM parties and panelists are encouraged to use the FORUM's party and panelist portals, through which documents may be uploaded or downloaded, fees may be paid, and relevant case information, such as deadlines, can be viewed. Each party can view all of their cases and deadlines at a glance, a feature many filing parties appreciate immensely. A highlight of FORUM's year was its implementation of the all-online RES policy. FORUM worked with ICM Registry to create a state of the art, online filing and case management platform. Cases are automatically calendared and moved through the dispute process, with case coordinator or legal oversight at critical intervals. Initial takedown decisions are made in as few as 48 hours. RES decisions are not publicly available. "The RES process has worked very well, with few problems." Dorrain commented. Cases filed with the National Arbitration Forum are heard and decided by Dispute Resolution Panelists who are primarily lawyers and judges with significant UDRP experience or who specialize in domain name, trademark, copyright and/or e-commerce law. Panelists have the opportunity to participate in at least one training session per year. Panelists are located around the world and can conduct proceedings in several languages including Dutch, English, Finnish, French, Japanese, Polish, Portuguese, Spanish, Russian, Chinese and Korean. The FORUM heard disputes filed by complainants from 25 different countries in 2011.
